Pre-Nuptial Post-Nuptial and Cohabitation Agreements

Fiction:   “Pre-nuptial agreements are only for wealthy people.”

FACT:   You do not need to have any assets to define your rights and obligations for the future. Honest discussions about these issues, now, will eliminate or reduce conflict regarding these issues, later.

Prenuptial Agreements

A pre-nuptial agreement helps both parties define their rights and obligations regarding debts and assets.

This greatly reduces the possibility of expensive, lengthy divorce proceedings regarding property division and spousal support. A pre-nuptial agreement assures you that if a divorce occurs, you will be protected.

Post-Nuptial Agreements

A post-nuptial agreement is one entered into after marriage, defining their rights and obligations toward each other.

For example, if one spouse owned a house before the marriage and the couple now shares it, that spouse may want to ensure that the title to the property remains in his or her name. Without a pre- or post-nuptial agreement, the other spouse may obtain an interest in the house.

Cohabitation Agreements

A cohabitation agreement allows an unmarried couple to define their rights and obligations toward each other.

For example, who will move out if the relationship ends? The agreement creates a legal framework for the relationship, although it may involve fewer commitments.
