Spousal Support
Fiction: “If my marriage was 10 years or longer, I will pay (or receive) support forever.”
FACT: Although there is a presumption regarding the payment of support for marriages lasting longer than ten years, there is no absolute rule. There are many factors which effect the amount and duration of support. The length of your marriage is only one factor.
Temporary Spousal Support
Temporary spousal support is available from the date your divorce begins until the date your divorce is finalized. It is meant to ensure that neither spouse is economically disadvantaged or placed under extreme hardship while the divorce is still in progress.
Temporary spousal support arrangements are typically calculated using court approved programs (the same programs used to establish child support payments).
Will Your Spousal Support Arrangement Be Permanent?
Not every marriage ends with permanent spousal support. The California Family Law Code requires courts to consider several factors in determining whether or not to award permanent spousal support.
These factors include the length of the marriage, the standard of living established during the marriage, the presence or absence of domestic violence, the ability of each spouse to earn an income and many other factors.
